House of Representatives Urges INEC to Conduct Bye-Elections for Vacant Seats

The House of Representatives has called on the Independent National Electoral Commission (INEC) to promptly conduct bye-elections to fill vacant seats in both the national and state assemblies. This resolution was reached during Tuesday’s plenary session, where lawmakers summoned INEC Chairman, Mahmood Yakubu, and other officials to address concerns regarding delays in the election process.

The motion, introduced by Jafaru Leko, the representative for the Bogoro/Dass/Tafawa Balewa federal constituency in Bauchi State, highlighted the need for urgent action. Leko, a member of the All Progressives Congress (APC), noted that since the conclusion of the 2023 general elections, several lawmakers at both state and national levels have either resigned or passed away, leaving their constituencies without proper representation.

Citing Section 76(2) of the 2022 Electoral Act, Leko stressed that INEC is legally mandated to hold bye-elections for these vacant positions. He argued that the prolonged absence of elected representatives disenfranchises the citizens of the affected constituencies, depriving them of their fundamental right to representation.

“The delay in conducting bye-elections for these vacant seats contravenes constitutional provisions, breaches due process, and undermines the proper representation of the affected constituencies,” Leko asserted. He further warned that INEC’s inaction not only violates democratic principles but also disrupts legislative activities, as committees and plenary sessions lack full participation from duly elected members.

Describing the situation as a “dangerous precedent,” Leko cautioned that failing to adhere to constitutional and electoral laws could weaken democratic governance, making compliance with legal provisions seem optional rather than mandatory.
